Conditions for Campervan & Motorhome Rental (Australia)

Rates and conditions
Rates and conditions quoted are subject to change without notice. However (subject to changes in legislation or errors) we will not alter rates or conditions applicable to your rental once your booking has been confirmed by Lucky. Please note all prices are quoted and payable in Australian dollars.
 
NOTE* Lucky vehicles are a 'well loved' campervan which is ideal for backpackers or the budget conscious who prefer saving money to driving the latest vehicle models. They are older models with a high mileage, but they are well maintained mechanically, easy to drive and will ensure you have more money in your pocket to spend on your trip. Rates include: standard vehicle insurance, 24-hour roadside assistance, basic cooking equipment, route planners, camping park directories and other tourist information.

Rental Duration

Rental days are calculated on a calendar day basis. When calculating the number of days the Vehicle is rented, the day of pick-up is counted as day one of the rental, regardless of pick-up time. The day of the Vehicle’s return is counted as the final day of the rental regardless of drop-off time. Late pick up or early return of the Vehicle does not entitle the Customer to any refund of the unused portion of the rental.
 
Minimum days & one way rentals
Minimum rental period is 5 days. Minimum hire period for one-way rentals is 10 days. Minimum rental periods are subject to change, and any such change will be notified to you prior to booking confirmation.

Delivery and Return of the Vehicle
A set pick up and drop off time is required on each booking. Lucky Rentals reserves the right to release the vehicle 24 hours after the scheduled pick up if the hirer has not advised Lucky Rentals of any change to pick up date. The vehicle must be dropped off at the specified time. Lucky Rentals allows a grace period of 59 minutes. A fee equal to the daily rental rate may apply for drop offs after this time
 
Change of drop-off destination
If the Customer wishes to change the drop-off destination, they must first obtain authorisation from the Reservations centre Subject to the change being approved and additional charge of up to AU$1250 may apply, which will be notified to you at time of approval The fee may apply in all cases irrespective of the reason for location change.
 
Late Drop-offs
If the Customer wishes to drop-off the Vehicle after business hours, they must first get approval from the destination branch. Subject to approval, a fee of AU$150 is applicable and the Customer will be required to pay an extra day’s Liability Reduction Premium (based on the Liability Reduction Option selected) as they will be held responsible for the Vehicle up until the time that it is checked in by a Lucky staff member.

 

Rental Extension
If the Customer wishes to extend the rental whilst on hire, they must first obtain authorisation from Lucky. This is subject to availability The extra cost of an extended rental must be paid by credit card on confirmation of the rental extension. Failure to obtain an authorisation for a rental extension will result in a late fee of AU$150 per day in addition to the daily rental rate (plus liability reduction charges) for each day until the vehicle is returned. The daily rental rate charged will be the rate applicable on the day of extension (which may differ from the original rate booked) per vehicle for the extended rental period.
 
Outback Roadside Cover
Outback Roadside Cover of an additional AU$10 per day will apply to all hires traversing through areas defined by Lucky Rentals as the Outback and is irrespective of how many days of the hire are spent in the Outback. A diagram of such areas is available from our reservations team or branch staff. If an Outback Fee is not paid for at pick up of the vehicle, then the hirer is fully liable for the costs of any accident, irrespective of fault, and / or breakdown of the vehicle that occurs in such areas.

Extra Fees

• If the vehicle is not returned washed, vacuumed and tidy, a cleaning fee of AU$100 will apply
• If a portable toilet (where applicable) is not returned empty, a cleaning fee of AU$100 will apply
• All vehicles are designated smoke free. If smoking is undertaken inside the vehicle, a cleaning fee of AU$100 will apply
 
A compulsory cleaning fee of $25 is applicable on all bookings.
 
Multiple Rentals
Should the hirer have more than one rental, bookings can be combined to qualify for duration of hire discounts if all travel is within a 6 month period. If the drop off of one vehicle and the pick up of a new vehicle occurs on the same day then each day will be charged separately per respective rental. This applies to vehicles rented from Lucky Rentals in either Australia or New Zealand.
 
Licence
No special drivers licence is required to drive in Australia, however all drivers must hold a current valid drivers licence for the duration of the hire period. No minimum or maximum age restriction applies.
 
Use of the vehicle:
The hirer is fully liable for any and all damages or costs when:
  • These terms and conditions are breached
  • Negligence or wilful misconduct has occurred
  • Incorrect or contaminated fuel is used (this includes running out of fuel or
  • putting fuel in the water tank or system)
  • The vehicle is used in contravention of any legislation or regulation
  • The hirer takes the vehicle onto a beach or sand
  • The vehicle becomes submerged, flooded, bogged or immobile
  • The hirer does not obey height-restricted areas (such as, but not limited to, car parking buildings) and damage is caused to the roof of the vehicle
  • The hirer is involved in a single vehicle rollover. This includes, but is not limited to, a vehicle that has rolled, tipped, or fallen over on its side
  • Driving on gravel or unsealed roads (there are no restrictions on which roads the vehicle can be driven on, however, travel on gravel or unsealed roads voids all liability limitations)
  • Retrieving, storing and recovering the vehicle to the agreed rental location following an accident
  • The hirer has failed to stop and contact Lucky Rentals when a warning light appears on the dashboard
  • The hirer continues to drive the vehicle following the temperature gauge moving in a direction which shows a departure from the normal operating temperature
  • The hirer continues to drive the vehicle after a mechanical breakdown or failure (including an accident) has occurred
  • The hirer has an accident involving an animal whilst driving between dusk and dawn (night driving) outside of any city limits.
  • The hirer, at Lucky Rentals request, does not complete an insurance claim form following an accident
  • Any and all costs resulting from, but not limited to, an accident or breakdown occurring while traversing the are defined by Lucky Rentals as the Outback without having selected and paid for the Outback Fee as described in these terms and conditions
Maintenance and Repairs
 
The hirer shall take all reasonable care to ensure that the vehicle is properly checked and maintained during the hire period. This shall include daily checks of the oil, water and tyre pressures. The vehicle is covered by 24 hour, 7 days road-side assistance. Mechanical breakdowns must be reported to Lucky Rentals as soon as possible in order to give Lucky Rentals the opportunity to rectify the issues during the hire. In order to facilitate on-road repairs, Lucky Rentals may require the hirer to take the vehicle to an approved repairer.
The hirer is not entitled to any refund unless Lucky Rentals has been advised of the issue, and has been given the opportunity to rectify the situation. A refund can be requested from Lucky Rentals if a breakdown has directly caused a delay in travel in one location of 48 hours or more. Lucky Rentals is not liable for any delays in rectifying a situation caused by a breakdown occurring on a weekend or public holiday.
 
On-road assistance
The vehicle is covered by 24 hour, 7 days road-side assistance. This service covers any mechanical malfunction or failure of the vehicle. Please note that this service does not cover the following: • The vehicle running out of fuel • Keys being locked inside the vehicle or lost • Flat batteries caused by incorrect usage of the batteries and /or incorrect usage of any equipment that requires the batteries in order to operate • A breakdown because of damage caused in an accident • A breakdown caused by willful neglect The hirer may be liable for a minimum charge of AU$85 by the road-side assistance provider in the event assistance is required for the above.

 

Title to Vehicle
The Customer acknowledges that Lucky retains title to the Vehicle at all times. The Customer shall not agree, attempt, offer or purport to sell, assign, sub-let, lend, pledge, mortgage, let on hire or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle.
 
For your Protection
Personal Injury is covered in most cases through Registration Third Party Insurance. However, we strongly recommend that all people travelling in Australia take out Personal Travel Insurance. Lucky does not accept any liability for personal injuries sustained during rental.

 

Vehicle protection options
The Customer understands that:
a) the Vehicle is insured for third party Vehicle and property damage;
b) the Customer will have to pay a liability fee in respect of any damage incurred whilst in the Customer’s possession;
c) the liability fee may be reduced by taking out Liability Reduction coverage (see below)
Any Liability Reduction is void, and the Customer will be responsible for the total cost of any damage if the Customer breaches any of the conditions of the use of vehicle clause
If no Liability Reduction Option is taken, the customer is responsible for the first AU$2,500 of the cost of damage
Note: Standard Cover & the Liability Reduction option do not cover tyre & windscreen damage
Stress Free Package covers all damage including all glass breakages (with the exception of sunroof and roof pod), under body & overhead damage

Stress Free Package
Stress Free Package is a full cover option, where the Stress Free Package is taken out, the hirer will not have to pay any liability for any damage to the vehicle Includes:
• One complete windscreen replacement or multiple windscreen chips 
• Multiple tyre replacement 
• Free extra drivers 
• Free hire of a picnic table, and a chair for each passenger 
• Free hire of GPS 
• Free linen pack (max two (2) per booking) 
• Any and all damages or costs when the hirer is involved in a single vehicle rollover 
• Any and all damages or costs when the hirer does not obey height-restricted areas and damage is caused to the hired vehicle 
• All associated costs when retrieving, storing and recovering (or disposing of) the vehicle to the agreed rental location following an accident

Exclusions
The Customer acknowledges that they are responsible for all costs for the following damage irrespective of Liability Reduction options that may have been taken.

Damage as identified below is specifically excluded from any Liability Reduction or Stress Free Package limitation of liability and the Customer remains fully liable for all costs incurred:
Insurance does not cover the hirer’s personal belongings
The hirer is fully liable for any and all damages or costs when:

  • These terms and conditions are breached
  • Negligence or wilful misconduct has occurred
  • Incorrect or contaminated fuel is used (this includes running out of fuel or putting fuel in the water tank or system)
  • The vehicle is used in contravention of any legislation or regulation
  • The hirer takes the vehicle onto a beach or sand
  • The vehicle becomes submerged, flooded, bogged or immobile
  • The hirer does not obey height-restricted areas (such as, but not limited to, car parking buildings) and damage is caused to the roof of the vehicle
  • The hirer is involved in a single vehicle rollover. This includes, but is not limited to, a vehicle that has rolled, tipped, or fallen over on its side
  • Driving on gravel or unsealed roads (there are no restrictions on which roads the vehicle can be driven on, however, travel on gravel or unsealed roads voids all liability limitations)
  • Retrieving, storing and recovering the vehicle to the agreed rental location following an accident
  • The hirer has failed to stop and contact Lucky Rentals when a warning light appears on the dashboard

Forms Of Payment Accepted
Lucky accept the following method types for the balance of payment.
  • Credit card - Visa MasterCard or Amex - A non-refundable surcharge fee of 2.5% on all Visa and MasterCard transactions and 5.0% on all American Express transactions applies.
  • Debit Card - Visa or MasterCard
  • AUD cash - Please note that the correct amount is required for all cash payments as no change is available.
  • AU EFTPOS card
 
Vehicle Security Deposit
 
Lucky Rentals requires a credit card to be used as a bond on all rental agreements and this must be the credit card of the main hirer unless prior arrangements have been made. A cash bond can be used however this will be the insurance excess or a minimum of AU$250 and be retained by Lucky Rentals for 28 days following the conclusion of the hire.
Lucky Rentals reserves the right to process a customers credit or debit card pertaining to the rental after the hire period. The hirer is liable for all administration, collection and legal costs in respect of charges payable under these terms and conditions
A non-refundable surcharge fee of 2.5% on all Visa and MasterCard transactions and 5.0% on all American Express transactions applies.

PLEASE NOTE: Electronic Credit cards are not accepted for Bond Payments. An electronic credit card is one where the numbers are not raised.
 
Procedures in Case of Accident
If the Customer is involved in a motor vehicle accident whilst on hire, the following procedures should be followed:

a) AT THE ACCIDENT SCENE THE CUSTOMER MUST:
  • 1. Obtain the names and addresses of third parties and any witnesses.
  • 2. Report the accident to police, regardless of estimated damage costs.
  • 3. Not accept blame or insist the other party is at fault.
  • 4. If possible, photograph damage to all vehicle(s) and registration number(s).
  • 5. Phone the nearest Lucky Branch with the accidents details within 24 hours.

    b) AT THE BRANCH:
     
  • 1. The Customer must produce their Driver’s Licence and hand over the police report (if applicable) and any supporting photographs.
  • 2. The Customer is required to pay the liability fee (if applicable) and any other amount due by them in respect to any damage arising from an accident, loss, or damage. This amount is payable at the time of reporting “the event” and not at completion of the Rental Period.
  • 3. The Lucky Customer Service Representative will ensure the motor Vehicle Accident Report is completed clearly and accurately signed by the Customer.
    c) EXCHANGE VEHICLE:
  • 1. The availability of an Exchange Vehicle is not guaranteed; provision is subject to availability, client location, accident liability and remaining hire duration. Client charges may be incurred (see below).
  • 2. If an exchange Vehicle is required as a result of an accident, the Customer is responsible for making their own way to the nearest Lucky branch or pick up location at their own cost.
  • 3. The Customer will pay for any costs relating to delivery of a change over vehicle as a result of any single vehicle accident. This charge applies irrespective of any liability reduction taken.
  • 4. A new Security Bond will be required for the exchange vehicle.
  • d) TIME FRAME FOR SETTLEMENT OF CUSTOMER LIABILITY CLAIMS:
     
  • 1. Lucky shall use best endevours to ensure that any money due back to the client is forwarded as quickly as possible, however third party claims can take months or even years to resolve. Lucky cannot force the destiny of these claims, and the customer acknowledges that handling of these claims is up to Luckys Insurer and the third party, whether they be insured or not.
  • 2. Lucky agrees to refund any liability fee refunds applicable within 60 days of receiving final resolution and payment relating to third party claims.
  • 3. For information regarding outstanding claims or liability fee refunds please contact the Claims Department on +64 9 374 4360 during office hours.
  • 4. The customer agrees to provide all reasonable assistance to Lucky in handling any claim including providing all relevant information and attending Court to give evidence.

    IMPORTANT NOTE: Under no circumstances should the Customer attempt to start or drive a vehicle that has been involved in an accident, damaged by roll-over, water submersion or any other means without permission from Lucky. If the vehicle is un-drivable after an accident and the Customer would like to have a replacement vehicle, which will be subject to time, distance and availability, the Customer must make his/her own way (at the Customer’s expense) to the nearest Lucky branch. Should the Customer require a change over vehicle, a new Liability Reduction policy will be required.
 
Baby Seats/Booster Seats
Lucky do not hire out baby or booster seats. Clients must bring their own. Child seats cannot be fitted to the Lucky Crib. Anchor Points are by request only.

 

Infringements
Lucky reserves the right to charge the Customer for any speeding, parking or toll way fines, associated administration costs and/or accidents including third party property damage not reported on return of the Vehicle The administration fee per incident will be AU$50.

 

Rental charges
Total charges as set out in your rental agreement are not final The Customer will pay any shortfall in charges to Lucky and the Customer will receive a refund for any over charges made by Lucky. Wherever possible, any amendment to charges will be notified to the customer at conclusion of rental, and the customer agrees to payment of any such charges at the time.

 

Payment of Changes- Joint and Several Liability
All charges and expenses payable by the Customer under this Agreement are due on demand by Lucky including any collection costs and reasonable legal fees incurred by Lucky. When the Customer comprises of more than one person, each person is liable jointly and severally for all obligations of the Customer pursuant to this Agreement.

 

Credit card Payment
If a credit card is presented as payment, the credit card holder will be jointly and severally liable as a Customer. The following credit cards will be accepted: Visa, MasterCard, and American Express. A 2.5% surcharge applies to the use of Visa and Mastercard, 5% for Amex payments and security bond purposes. When payment is made by credit card, the Customer agrees that:

a)Lucky is irrevocably authorised to complete any documentation and take any other action to recover from the Customers credit card issuer all amounts due by the Customer pursuant to this Agreement, including, but not limited to, any amounts due in respect of damage to the Vehicle or to property of a third party and all other additional charges as they are incurred including all parking and traffic infringement penalties, road toll fines and associated administration costs;
b) The Customer will not dispute his/her liability to Lucky for any amount properly due under this Agreement and the Customer shall indemnify and keep indemnified Lucky against any loss incurred (including legal costs) by reason of notifying the Customer’s credit card issuer of such dispute;
c) In the event that Lucky elect to accept payment of the Security Deposit by holding a signed and authorised open credit card voucher which is returned to the Customer at the completion of the Rental Period, the Customer agrees that Lucky is entitled to recover payment from the Customer’s credit card issuer pursuant to paragraph (a) in respect of any amounts due which were not known at the time of return of the voucher;
d) Lucky may process credit card charges pertaining to the rental after the hire period. The Customer acknowledges that all transactions under this Agreement are conducted in Australian dollars. Due to exchange rate fluctuations and bank fees, there may be a variance between the amount initially debited against the Customer’s credit card and the amount refunded. Lucky accepts no liability for any such variation.
 
Personal and company cheques
Personal and Company cheques will not be accepted as payment for rentals at the time of pick-up Personal or Company cheques are not acceptable as the vehicle security deposit.
 
Conditional Upon Payment
The Customer agrees that provision of any rental vehicle is conditional upon Lucky being paid (prior to travel commencing) by the Travel Agent or Travel Wholesaler who arranged the vehicle rental on the Customer’s behalf.

 

Terminating The Agreement and Repossessing the Vehicle
The Customer acknowledges that Lucky may terminate this Agreement and repossess the Vehicle (and for that purpose enter upon any premises and remove the vehicle) at any time, without notification to the customer, and that the Customer will pay the reasonable cost of repossessing the Vehicle, including towing charges if:

  • a) The Customer is in breach of any material term of this Agreement
  • b) The Customer has obtained the Vehicle through fraud or misrepresentation;
  • c) The Vehicle appears to be abandoned;
  • d) The Vehicle is not returned on the agreed return date or Lucky reasonably believes that the Vehicle will not be returned on the agreed return date; or
  • e)Lucky considers, on reasonable grounds, that the safety of the passengers or the condition of the Vehicle is endangered. The Customer understands that in the event of such termination or repossession, the Customer has no right to a refund of any part of the rental charges or the Security Deposit.

Cancellation and Amendments

Cancellations up to 45 days prior to pick-up - Loss of Deposit or 20% (whichever is greater)
 
In the case of cancelling your reservation less than 45 - 11 days  prior to pick-up, the deposit is Non Refundable. In addition there is a $100 cancellation fee.
 
Cancelled 1 – 10 days prior to pick up 50% of the rental (including accessories and excess reduction option) is payable In addition there is a $100 cancellation fee
 
Cancelled on the day or no show 100% of the rental (including accessories and excess reduction option) is payable

Amendments are charged at a rate of $50 per change. This applies but is not limited to changing the client name, vehicle type, reducing the number of rental days, changing the pickup dates or locations. No refund given on the initial deposit paid.

If an amendment is made to the rental whereby the length of hire is shortened, no refund will be given on the initial deposit amount nor can it be transferred to the balance payable on pick up. In addition, if an amendment is made inside 14 days of pick up, the rental will be charged at the number of days originally booked. A relocation fee may also apply if the collection or return location is amended.

Where the hire is being extended, the amendment fee will not apply.

Please note that amendments may result in the daily rental rate to be recalculated at the rate applicable on the date of the amendment for the entire rental period.
 
If a bookings travel dates are amended within the cancellation fee period to be outside of the cancellation fee period and is subsequently cancelled, the cancellation fee for the original booking will apply.
